FunWebStudios.com Content Creator Agreement

Effective Date: 07/23/2024

Parties:

FunWebStudios.com ("Platform"),
Content Creator ("Creator"), an individual or entity creating and uploading content to the Platform.
1. Acceptance of Agreement

By clicking the checkbox provided on the Platform, you, the Creator, agree to the terms and conditions set forth in this Content Creator Agreement ("Agreement").

2. License and Ownership

a. Grant of License: Creator grants FunWebStudios.com a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, display, and perform the content uploaded by the Creator on the Platform.

b. Ownership: The Creator retains ownership of the content. FunWebStudios.com does not claim any ownership rights over the content uploaded by the Creator.

3. Content Standards

a. Compliance: All content uploaded must comply with applicable laws and regulations, as well as the Platform’s community guidelines.

b. Prohibited Content: The Creator agrees not to upload content that is unlawful, offensive, defamatory, or otherwise objectionable.

4. Compensation

a. Revenue Sharing: Creators may be eligible for revenue sharing based on the monetization policies of FunWebStudios.com. Details will be provided separately and may be subject to change.

b. Payment Terms: Payments, if any, will be made to the Creator based on the agreed-upon revenue-sharing model and will be subject to the minimum payout thresholds.

5. Warranties and Representations

a. Ownership: The Creator warrants that they own or have the necessary licenses, rights, and permissions to upload and grant the rights to the content.

b. Non-Infringement: The Creator warrants that the content does not infringe any intellectual property rights, privacy rights, or other rights of any third party.

6. Term and Termination

a. Term: This Agreement shall commence on the Effective Date and continue until terminated by either party.

b. Termination: Either party may terminate this Agreement at any time, with or without cause, by providing written notice to the other party.

7. Indemnification

The Creator agrees to indemnify, defend, and hold harmless FunWebStudios.com, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses arising out of or in any way connected with the content uploaded by the Creator.

8. Limitation of Liability

FunWebStudios.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9. Miscellaneous

a. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Florida United States, without regard to its conflict of law principles.

b. Entire Agreement: This Agreement constitutes the entire agreement between the parties regarding its subject matter and supersedes all prior agreements and understandings.

c. Amendments: FunWebStudios.com reserves the right to modify this Agreement at any time. The Creator will be notified of any changes, and continued use of the Platform constitutes acceptance of the modified terms.
